ESB shall not be liable for any such costs or expenses under any circumstances. Information obtained during the preliminary market consultation will not be used in any way which would have the effect of distorting competition or would result in a violation of the principles of non-discrimination and transparency. No party will be advantaged or disadvantaged during any subsequent procurement process as a result of information submitted (or not submitted) by it in the course of the preliminary market consultation. Parities do not need to participate in this preliminary market consultation process to take part in any subsequent procurement process.
