Explanation
A Request for Tenders for the provision of Hardware, Software and Related Services Support for an existing Security Information and Event Management (SIEM) Solution was sent to the OJEU for publication on 20 March 20 (TED reference 2020/S 059-141744). There were no suitable tenders received to the open procedure by the response deadline.
The Contracting Authority reviewed Article 32 of Directive 2014/24/EU and agreed that the negotiated procedure without prior publication could be invoked for the following reasons:
1. No suitable tenders were submitted to the initial open procedure invoked by the Contracting Authority;
2. The response received to the open procedure was considered unsuitable as it was manifestly incapable of meeting the contracting authority’s needs and requirements as specified in the procurement documents.
The Contracting Authority reviewed Article 32 of Directive 2014/24/EU and agreed that the negotiated procedure without prior publication could be invoked for the following reasons:
