Short description

The PSRA (Contracting Authority) requires an external managed investigation support service provider to support it in the performance of the inspection functions as provided for in Section 65 and Section 89 of the Property Services (Regulatory) Act 2011 and set out in detail in Appendix 1 to this RFT. In summary, the selected provider will be required to provide the Authority with;
(i) Suitably qualified and experienced individuals to carry out statutory investigations regionally under the authority of the PSRA (Inspectors); and
(ii) A dedicated individual to manage the service provision who will liaise with the Authority in supporting its administration of statutory investigations (the Service Manager).
It is envisaged that an initial inspection team of at least ten Inspectors will be required to also include all necessary managerial and administrative support.

Description of the procurement

The Property Services Regulatory Authority (PSRA) was established in 2012, under the Property Services (Regulation) Act 2011, to licence and regulate the provision of property services in Ireland by Auctioneers, Estate Agents, Letting Agents and Property Management Agents. The main function includes the undertaking of audits of licensed Property Services Providers, investigation of complaints and unlicensed operators in the sector.

Review procedure

Precise information on deadline(s) for review procedures: 
Instrument SI 130 of 2014, until after the expiry of the standstill period which commences on the day following the date of notification of concerned candidates and tenderers.
The duration of the Contracting Authority will not conclude this framework agreement (and the reviewable public contract) to which a standstill period applies in accordance with Irish Statutory standstill period will be 14 calendar days where notifications are sent electronically or by fax and 16 calendar days where these are sent by any other means.
The Statutory Instrument mentioned above provides that review procedures are available in the High Court to a person who has or has had an interest in obtaining the framework agreement (including the reviewable public contract and alleges that he or she has been harmed or is at risk of being harmed by an infringement of the law in relation to that framework agreement and reviewable public contract.
