The relevant funds are expected to be placed and retained in escrow, pursuant to an Escrow Agent/Custodian Agreement with the successful tenderer, pending the outcome of the applications for annulment of the European Commission's decision. The duration of the Escrow Agent/Custodian Agreement cannot be fixed at the outset (notwithstanding section II.2.7 below); it is expected to remain in place pending the outcome of those applications.
