The objective of this Voluntary Ex Ante Transparency (VEAT) notice is to inform the market of Dublin City Council’s intention to enter into a contract with Tekenable Limited in accordance with Article 32.2(b) (i.e. the works, supplies or services can be provided only by a particular economic operator for any of the following reasons: (ii) competition is absent for technical reasons; (iii) the protection of exclusive rights, including property rights).Dublin City Council operate a HGV Permit Checker System which consists of a front-end mobile application and a back-office data analytics portal to assist with enforcement of the HGV Management Strategy in Dublin City. This is a complex bespoke system that Tekenable Limited designed from prototype to product over several iterations between 2017 and 2019, following a tendering process they were awarded a contract to design the system and provide application support for 3 years with an option to extend for 2 further years. The contract between Dublin City Council and Tekenable Limited for application support and maintenance is exhausted as of August 2022. The HGV Permit Checker System is a tool that is still very much in use by citizens, An Garda Síochána and the Traffic Department.Therefore, it is necessary to have application support and maintenance for the HGV Permit Checker System to ensure the system security and availability to end users. In accordance with Article 32 Section 2 (b) (ii) due to the nature of the bespoke and technical complexity of the system described above it is deemed necessary to derogate from procurement procedures and award a four year contract to Tekenable Limited for support and maintenance of the HGV Permit Checker System to the value of €48,800.
