Regarding the EU Directive and procurement procedure referenced in this Notice, it should be noted that a clarification notice was published to confirm that this opportunity was structured as a concession as defined in Directive 2014/23/EU and the process conducted would be broadly aligned with a restricted procedure, although the NTMA reserved the right not to follow all elements of a typical restricted process.
The amounts indicated in Section II.1.7) and Section V.2.4) of this notice in respect of the total value of the procurement/contract are approximate, calculated by reference to a 5 year period and projected net sales (which may vary). The actual aggregate value of the contract cannot be determined at this time and amounts payable will depend on a variety of factors including volume of sales and the level of “non-core” services that may be required by the NTMA during the term of the contract.
