Currently 1,843 shelters are maintained by Bus Átha Cliath (Dublin Bus) and Bus Éireann. The National Transport Authority (“Authority”) intends to enter into an agreement for the maintenance of these existing bus shelters, the provision of additional bus shelters, the provision of additional advertising media at existing bus shelters (including digital advertising media), the provision of advertising media at new bus shelters and the exploitation of such advertising media by way of sale of advertising rights for both existing and additional bus shelters. Tenderers should note that the Authority retains the right to exclude bus shelters (including existing bus shelters) from this Contract as its sole discretion.
The Contract will also provide for the potential installation (at the Authority’s absolute discretion) of additional advertising panels at non-bus shelter locations and the exploitation of such advertising media by way of sale of advertising rights.

Where the successful Tenderer is a consortium of firms/partnerships, the Authority anticipates that it will require each member of the consortium to be jointly and severally liable for the performance of the Services. However the Authority reserves the right to require that the successful Tenderer contract in such other form as may be deemed appropriate by the Authority, for example by way of a lead contractor executing the contract, with the other group members being sub-contractors to the lead contractor (in which case sub-contractor direct agreements between the Authority and other group members may be required). Additional information

The Estimated Value of the Contract as set out in sections II.1.5) and II.2.6) above represents an estimate of the anticipated payments that may be made by the Authority to the successful Tenderer over the duration of the Contract in respect of the supply, maintenance and removal of bus shelters. In addition to this, the successful Tenderer will be required to exploit the advertising media potential of the bus shelters through the sale of advertising rights and the provision of advertising services. It is anticipated that the revenue associated with the advertising sales and services will be shared between the successful Tenderer and the Authority on the basis of a revenue share arrangement to be proposed in the tender. Refer to the procurement documents for further details.
Although this competition is being conducted under the open procedure, Tenderers should note that it is anticipated that the Authority will engage in some degree of pre-tender engagement with Tenderers regarding the form of contract and the design submission.
Tenderers should note that the Authority reserves the right to order bespoke bus shelters from the successful Tenderer. Refer to the procurement documents for further details.
The contracting authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers relating to this contract award procedure irrespective of the outcome of the competition, or if the competition is postponed or cancelled. All costs incurred by interested parties in participating in this competition must be borne by them.
Any contract award will be subject to a number of preconditions, including production of a current tax clearance certificate or tax clearance statement from the Revenue Commissioners in Ireland. The contracting authority may terminate this competition (or any part thereof), change the basis of and the procedures for the bidding process, at any time, or procure the project by alternative means if it appears that the project can thereby be more advantageously procured. The most economically advantageous or any tender will not automatically be accepted. Refer to procurement documents for further information.
