Short description

The CRU, with the consent of the Minister for the Environment, Climate and Communications, directed EirGrid under Regulation 28(10) of The Public Contracts Regulations 2015, in its capacity as the Transmission System Operator, to secure the delivery of c. 450MW of emergency temporary generation. In fulfilment of that direction, EirGrid, through a wholly owned special purpose vehicle (EirGrid SPV 2022 Designated Activity Company) has procured from the market electricity generation plant for the purpose of subsequent transfer of that plant to one or more electricity generators in accordance with the EirGrid, Electricity and Turf (Amendment) Act 2022.

Type of procedure

Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the directive
Explanation
The CRU, with the consent of the Minister for the Environment, Climate and Communications, directed EirGrid under Regulation 28(10) of the of The Public Contracts Regulations 2015, in its capacity as the Transmission System Operator, to secure the delivery of c. 450MW of emergency temporary generation. Securing the delivery of temporary emergency generation is required to address the likely and substantial risk of a national security of supply emergency. The purchase of equipment is the first stage in that process and in tandem EirGrid is engaging with electricity generators for the purpose of subsequent transfer of the purchased plant in accordance with the EirGrid, Electricity and Turf (Amendment) Act 2022. Given the extreme urgency of the situation, it was not possible for EirGrid/the SPV to comply with the time limits specified for open procedures, restricted procedures and negotiated procedures with prior call for competition.
