Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

List and brief description of conditions:  a. Insurance companies must be authorised by the competent Authority of the Member State from which insurance is being provided.
b. If insurance is being provided on a cross border basis the insurance company must comply with the appropriate provisions of the second non life Insurance Services Directive implemented in Ireland by S.I. No 142 of 1991 as amended by S.I. No 244 of 1992 and the Insurance Amendment Act 2011 relating to the provision of large risk insurance business.
c. Any candidate found guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
d. All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register

Contract performance conditions

Due to the nature of the Insurance required, once the insurance has been called on by the Contracting Authority, the Contracting Authority require immediate access to the cover in order to carry out their function to Investigate an accident in the timely fashion required.
Agreement will be reached by the successful Tenderer and the Contracting Authority as to the claim handling protocol that will operate in an accident scenario. The tenderer must provide their agreement in writing to this requirement prior to any contract being signed by the Contracting Authority
