Additional information

1) RDI Hub is led by Company founders FEXCO, IT Tralee (ITT) & Kerry County Council involved respectively in the areas of financial services, education, research and enterprise development.
2) This Notice is being advertised on a voluntary basis in the OJEU as the value of the contract falls below the works threshold value defined by the EU Public Procurement Directives. Therefore, none of the rules of the Directive apply to the award procedure for this project and that includes those relating to timescales, selection and award criteria and notifications to candidates and tenderers and all the other rules;
3) This project and the associated works contract is part funded under the Regional Enterprise Development Fund of the Irish Government's Department of Business, Enterprise and Innovation, through Enterprise Ireland and the award of this original contract will be in accordance with the Irish Government's Capital Works Management Framework (CWMF).
4) The awarding authority reserves the right to liaise with a separate entity (namely FEXCO) which contemplates undertaking further works on or adjacent to the site, including the sharing of information on a strictly confidential basis in relation to this current competition. In that regard the tenderer winning this RDI Hub contract will be required to offer the same or improved rates to FEXCO for any works contracts they may award within 12 months of the conclusion of this contract.
5) Regarding 4) above, the successful tenderer may be appointed to undertake further tasks of a similar or larger scale in relation to a different project by FEXCO, a private entity which is not a contracting authority.
6) Interested parties should therefore be aware that there are two separate entities potentially procuring different and separate works contracts in accordance with their respective technical specifications, on an independent basis. The RDI Hub contract being procured under this Call for Competition falls outside the procurement Directives because inter alia it's estimated value is significantly below the EU Works threshold. Moreover, the anticipated contract to be awarded by FEXCO also falls outside the scope of the procurement Directives since FEXCO is a private entity and not a contracting authority and no public funds are involved in this potential contract.
7) It is anticipated that the works contract as advertised will be delivered within a 7 month period after commencement of the works.
8) Interested parties must register their interest on the eTenders web site (www.etenders.gov.ie, RFT ID: 131747) in order to be included on the mailing list for clarifications. All information relating to attachments, including clarifications and changes, will be published on the Irish Government Procurement Opportunities Portal (www.etenders.gov.ie) only. Registration is free of charge. The contracting authority will not accept responsibility for information relayed (or not relayed) via third parties
9) The contracting authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers.
10) Contract award will be subject to the approval of the competent authorities.
11) It will be a condition of award that the successful tenderer is and remains tax compliant.
12) At its absolute discretion, the contracting authority may elect to terminate this procurement process at any time.
13) Without prejudice to the principle of equal treatment, the contracting authority is not obliged to engage in a clarification process in respect of the procurement documents with missing or incomplete information. Therefore, respondents are advised to ensure that they return completed documentation in order to avoid the risk of elimination from the competition.
