III.1.1)

Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

List and brief description of conditions:  1.4.4 All Civic Amenity Centres shall be under the control of a suitably qualified person; known as the Facility Manager for the life span of the contract. The Facility Manager shall be competent in Waste Management and shall have successfully completed the FAS Waste Management Training Programme or equivalent.

b) A statement from the Tenderer’s Bankers that the Tenderer is financially capable of undertaking a service contract of this size at this time.

Conditions related to the contract

III.2.2)

Contract performance conditions

1.12.1 In the event of there being any breach on the part of the successful Service Operator of the terms and conditions hereof and in the event of the said breach not being rectified in fourteen days of having been so notified in writing of same the Authority shall be entitled to terminate the agreement by giving one months notice in writing to the successful Service Operator and thereupon the successful Service Operator shall be entitled only to payment for services rendered up until the date of termination less the costs (if any) incurred by Limerick City & County Council in remedying the said breach. Limerick City & County Council reserves the right to re -enter the Civic Amenity Centres forthwith if there have been any breaches of the terms of the agreement.
