A framework agreement was reached between the two jurisdictions for the repatriation of this waste. Dublin City Council, as the competent authority for the Republic of Ireland, requires a service for the disposal/recovery of waste from up to five of these sites to an authorised facility in the Republic of Ireland.

Description of the procurement
Since 2000, thousands of tonnes of waste were illegally deposited at various sites in Northern Ireland which had origins in the Republic of Ireland. The waste is predominantly mixed municipal solid waste, including construction and demolition waste and inert waste. Following agreement between the authorities in Northern Ireland and the Republic of Ireland, and supported by the European Commission, a framework agreement was reached between the two jurisdictions, drawing on the provisions of Regulation (EC) No. 1013/2006 of the European Parliament and of the Council on 14 June 2006 on Shipments of Waste. Article 24 of this Regulation provides for the take-back of illegal shipments of waste by the competent authority of dispatch in consultation and agreement with the competent authority of destination.
Dublin City Council as the Contracting Authority is proposing to establish a Framework Agreement for the disposal/recovery of this waste from Northern Ireland. Tenderers are required to submit details of a waste licensed facility that can accept this waste for disposal or recovery. However, the haulage of the waste from the identified sites to the authorised facility shall not form part of this invitation to tender. A maximum of eight participants will be invited to execute a framework agreement, subject to the successful submission of a tender. There are up to five sites in Northern Ireland that will be excavated during this Framework Agreement. It is anticipated that each site will be subject to a mini-competition. The Framework Agreement shall have a term of three years but the Contracting Authority may, at its discretion extend the term by a period of one year.
