It is proposed that the Multi-Contractor Framework Agreement scope of works will include but will not be limited to (non-exhaustive list):
• remove timber related safety hazards which may present a danger to
members of the public or to ESB staff
• prevent physical damage to Overhead Network
It comprises planned timber cutting and associated works under the following headings:-
• 38kV: 3 year cycle
• 10/20kV: Rural Network, 3 year cycle
• Low Voltage: Rural Network, 6 year cycle
• 10/20kV: Urban Network, 4 year cycle
• Low Voltage: Urban Network, 4 year cycle
It also includes unplanned/response driven timber cutting and associated works for:-
• New Works-timber clearance and associated works
• Hazards on existing Network (not on the current programme cycle)
• Forestry-line related
• MV Live Line-timber clearance+associated works
• Emergency response e.g. storm
• Transmission-timber clearance+associated works
• Project related works

Description of the procurement

Multi-contractor Framework Agreement for Timber Cutting and Associated Works at or near Overhead Lines in the Republic of Ireland. The duration of the framework agreement is 3 years with an option to extend, at the contracting Entity's discretion, for a further 1+1+1 years.

Conditions related to the contract

III.2.2)

Contract performance conditions

The Contracting Entity is preparing a draft Multi-Contractor Framework Agreement and schedules that will be provided to the Pre-Qualified Applicants at the next stage of the Procurement process i.e. the Invitation to Tender stage. The Multi-Contractor Framework Agreement will set out the terms and conditions pertaining to the technical, commercial, financial, safety and legal requirements for the timber cutting works to be covered by the Multi-Contractor Framework Agreement. The works will be procured utilising bespoke terms and conditions based on the FIDIC conditions of contract for plant and design – build for electrical and mechanical plant, and for building and engineering works, designed by the contractor (incorporating FIDIC first edition 1999 reprinted in 1999) form of contract, as will be amended for the purposes of this particular scope of works and as required by the Contracting Entity.

Additional information

Please note the following information in relation to Notice sections above:-
* IV.1.3 – “...NUMBER OF PARTICIPANTS TO THE FRAMEWORK AGREEMENT 45”
The number of 45 stated in section IV.1.3 is an estimate only of the final number of contractors that may be required. The final number of contractors appointed to the framework agreement will depend on the contractor resource capacity of those ultimately determined by the Contracting Entity to have submitted the most economically advantageous tenders in accordance with the award criteria for this enquiry/in the procurement documents. The final number of contractors admitted to the framework agreement will be that number determined by the Contracting Entity to be sufficient to meet the framework agreement requirements and may be more or less than 45. More information will be set out in the Invitation to Tender, at that stage of the Procurement process.
* II.2.9 – “INFORMATION ABOUT THE LIMITS ON THE NUMBER OF CANDIDATES TO BE INVITED – 55”
The Contracting Entity reserves the right to increase or decrease this number subject to the number of applications/candidates that successfully prequalify.

Applicants/candidates that successfully prequalify and are subsequently Invited to Tender will be required to provide detailed information in their tender response in relation to their employees/staff including, but not limited to, the names and the qualifications of the employees/staff they propose to assign to works that may arise under the framework agreement. More information will be set out in the Invitation to Tender, at that stage of the Procurement process.

* NOTE 1 - INCOMPLETE PREQUALIFICATION QUESTIONAIRES (PQQ) AND/OR MISSING INFORMATION/ DOCUMENTATION
Subject to applicable law the Contracting Entity is not obliged to engage in a clarification process in respect of questionnaires that are not complete or are missing information/documentation and these questionnaires may be rejected by the Contracting Entity. Therefore Applicants/candidates are advised to ensure that they return FULLY COMPLETED questionnaires in order to avoid the risk of elimination from the Procurement process on the basis of an incomplete questionnaire.
