Single Party Framework Agreement for Occupational Health Services

Thirdly the decision to extend the potential duration of the contract is based entirely on the nature of the service and takes account amongst other concerns, the particularities of the doctor / patient relationship and the management of medical records which means that there are extensive and complex legal obligations surrounding the collection, use, disclosure and transfer of records and materials.
The framework agreement will be for a maximum of seven [7] years subject to satisfactory performance, business needs and budgetary constraints. The contract will be awarded initially for 3 years, with the option, purely at the discretion of The Council to extend for 2 x 2 year extensions.
For the avoidance of doubt, the contracting Authority confirms that the period of any contracts awarded under the framework agreement may extend beyond the date of expiry of the agreement.
The estimated total value of the any purchases pursuant to the framework agreement is in the region of €200,000 annually and €1.8 million excluding VAT) over the lifetime of the agreement.
It is emphasised, however, that this figure is provided strictly for indicative purposes only as there is no guaranteed expenditure under the framework agreement.
The Contracting Authority proposes to engage in a competitive process for the
establishment of a framework agreement for the provision of Occupational Health
Services.
A framework agreement constitutes a means of establishing overall terms and
conditions in accordance with which, for a specified duration, individual contracts
may or not be awarded.
The City Council wishes to appoint an Occupational Health Service Provider
(OHSP) in order that The City Council has a best in class occupational health
service (OHS) for the protection and prevention of its entire staff, including the staff
of the Dublin Fire Brigade, from ill health (or injury) arising from their work in The
City Council.
The City Council is seeking to enter into a proactive partnership based
arrangement to ensure that it meets the objectives of the contract in the most
efficient and cost effective way while at the same time facilitating an environment in
which improvements are openly presented.
The framework agreement will be awarded to the OHSP that is best able to provide
a service which in general includes, but is not limited to:
• Fitness for work and individual assessments
• Pre-employment medical examinations
• Fitness to return to work examinations
• Ill-health retirement examinations
• Vaccinations
• Health surveillance programmes
• Extensive examinations appropriate to emergency services personnel in
operations such as Dublin Fire Brigade

Additional Information – Dublin City Council
1. Dublin City Council is subject to the provisions of the Freedom of Information Act (FOI) 1997, 2003. In such cases, the relevant material, will in response to the FOI request; be examined in the light of the exemptions provided for in the Acts.
2. It will be a condition for the award of any contract by Dublin City Council that the successful Tenderer and all sub-contractors (if applicable) produce a valid Tax Clearance Certificate from the Revenue Commissioners in compliance with Circular (43) 2006 (or as amended) and that the certificate will be maintained for the duration of the contract and will be on a 12 month basis. In the case of a non-resident Tenderer, a statement of suitability from the Revenue Commissioners will be required.

4. 6. The contract/framework agreement is primarily for use by the Human Resources Department, but may also be extended for use by other divisions of Dublin City Council as requirements arise.

8. Tenders may be submitted in English or in the Irish language.
9. This notice is being published on a voluntary basis in the OJEU as the framework agreement is for a service which is a non-priority service (Annex IIB) and therefore not subject to the full rigours of the public procurement directive (2004/18/EC).
10. Please note that with the exception of Annex IIB services OJEU contracts are covered by the Government Procurement Agreement (GPA).
