Multi-Party Framework Agreement for eLearning Courseware

The value of each contract under the framework is estimated at Euro 9000 to Euro 11000 (excl. VAT).
It is anticipated that the number of contracts awarded will be 4 per annum approximately.
Health and Safety Authority invites tenders from competent firms for the establishment of a multi-party framework agreement for the development of elearning courseware on health and safety for specific groups of learners and work sectors including those in formal education.
The framework agreement will be for a maximum of 4 years, subject to satisfactory performance.
The estimated total value of any purchases pursuant to the framework agreement is in the region of Euro 144000 - Euro 176000 (ex. VAT) over the lifetime of the agreement (i.e. 4 years maximum). The value of each contract under the framework is estimated at Euro 9000 to Euro 11000 (excl. VAT).
It is anticipated that the number of contracts awarded will be 4 per annum approximately.
It is emphasised, however, that these figures are provided strictly for indicative purposes only as there is no guaranteed expenditure under the framework agreement. This framework agreement is not subject to Directive 2004/18/EC as its value falls below the relevant threshold.
The framework agreement will be for 2 years, with the option to extend for 2 years, subject to a maximum of 4 years subject to satisfactory performance, business needs and budgetary constraints.
For the avoidance of doubt, the Authority confirms that the period of any contracts awarded under the framework agreement may extend beyond the date of expiry of the agreement.

1) Interested parties must register their interest on the eTenders web site (www.etenders.gov.ie) in order to be included on the mailing list for clarifications. All information relating to attachments, including clarifications and changes, will be published on the Irish Government Procurement Opportunities Portal (www.etenders.gov.ie) only. Registration is free of charge. The contracting authority will not accept responsibility for information relayed (or not relayed) via third parties.
2) This is the sole call for competition for this service.
3) The contracting authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers.
4) Contract award will be subject to the approval of the competent authorities.
5) It will be a condition of award that tenderers are tax compliant and are in a position to produce a valid tax clearance certificate from the Irish Revenue Commissioners when requested.
6) If for any reason it is not possible to admit to the framework agreement one or more of the tenderers invited following the conclusion of this competitive process, the contracting authority reserves the right to invite the next highest scoring tenderer to join the framework agreement as appropriate. Likewise if any framework member has their membership terminated the contracting authority reserves the right to invite the next scoring tenderer to join the framework. Both options will only be used during the tender validity period at the discretion of the contracting authority.
7) At its absolute discretion, the contracting authority may elect to terminate this procurement process, the framework agreement or any contract awarded under the framework agreement at any time.
8) Please note in relation to all documents, that where reference is made to a particular standard, make, source, process, trademark, type or patent, that this is not to be regarded as a de facto requirement. In all such cases it should be understood that such indications are to be treated strictly and solely for reference purposes only, to which the words “or equivalent“ will always be appended.
9) Without prejudice to the principle of equal treatment, the contracting authority is not obliged to engage in a clarification process in respect of tenders with missing or incomplete information. Therefore, tenderers are advised to ensure that they return fully responsive tenders in order to avoid the risk of elimination from the competition.
10) This notice is being published on a strictly voluntary basis in the OJEU as the framework agreement, due to its value is not subject to Directive 2004/18/EC.
11) No contract may be implied due to the voluntary publication of the notice.
