Consultancy Support for Uisce Eireann’s Connection Charging Policy

The Commission for Energy Regulation (the CER) is the independent body responsible for overseeing the liberalisation of Ireland‘s energy sector. The CER was initially established and granted regulatory powers over the electricity market under the Electricity Regulation Act, 1999. CER‘s responsibilities were expanded with the enactment of the Gas (Interim) (Regulation) Act, in 2002; The Petroleum (Exploration and Extraction) Safety Act in 2010 and The Water Services Act, 2013 & Water Services Act, 2014.
CER is Ireland‘s economic regulator of the Irish public water and wastewater sector. CER currently wishes to engage consultancy support to provide policy and economic advice in regard to UÉ’s Connection Charging Policy.
The scope of UÉ’s Connection Charging Policy project is to provide the CER with advice to assist it in the establishment of UÉ’s enduring Connection Charging Policy. The CER will be undertaking a 4 stage consultation approach in developing UÉ’s Connection Charging Policy and Charge, as follows:
Stage 1: Publish Information and Background Paper (out of scope)
Stage 2: Consultation on Connection Charging Principles
Stage 3: Consultation on UE’s Connection Charing Policy
Stage 4: Consultation on UE’s Connection Charges and Ancillary Documents
The scope includes provision of policy advice regarding connection charging principles and charging designs as well as feedback and advice regarding UÉ’s Connection Charging Policy and Charge proposals.
The policy advice will be based on a phased delivery approach. Using a project gateway review, the successful tenderer will be required to complete the mandatory deliverables under Stage 2. Following completion of this stage, a decision will be made by the CER whether to progress with the first optional deliverable set out in Stage 3. Once Stage 3 has been delivered, the CER will decide whether to progress with the optional deliverables set out in Stage 4.

The scope of requirements for the provision of policy and economic advice for this project is as follows:
1. To review and advise on connection charging principles, charging designs and connection charges in place in other jurisdictions in order to benchmark various aspects of UÉ’s proposals against comparable utilities. The advice includes any clarifications requested by the CER.
2. To provide advice and assistance in the drafting of CER Consultation and Decision documents issued throughout the project.
3. To provide assistance in responding to comments/responses received at each stage of the consultation process (and meet with respondents as required).
4. To review and advise on UÉ’s Connection Charging Policy proposals (including proposed connection charges, associated financial security policy, connection offer/agreement pro-formas and connection terms and conditions). This review will need to take account of relevant national policy (implications and considerations).
The successful tenderer will also need to attend meetings and review information provided by UÉ at these meetings and provide assistance with any clarification questions throughout the Project.
5. To review any proposed UÉ connection charging model(s) and the methodology used to derive any charges. This will include providing assistance with any clarification questions.
6. To review and advise on any Connection Charging impact analysis of moving from the existing 34 Local Authority connection charging arrangements to the new national connection charging regime. This will include giving advice on possible transitional measures of moving from one regime to another.
7. To evaluate and provide a report on the impact of any proposed charging design on UÉ’s revenue, interactions with existing and future tariffs and network development plans etc.
8. To provide a presentation to CER Staff. The aim of this presentation will be to facilitate transfer of relevant experience on Connection Charging Policy to CER staff members.
The CER also requires the successful tenderer to work closely with the CER to develop the skill set of the CER staff working on this project. The CER sees the transfer of knowledge as a key prerequisite of this tender
Following the completion of the mandatory deliverables outlined in the specification of requirements, the CER will decide on whether to proceed with the optional deliverables. Should the first optional deliverable be completed, the CER may decide to exercise the option to initiate the second option. There is also an optional number of additional draw down contingency days provided for.
Options are as follows:
Option 1: Consultation on UE’s Connection Charging Policy (Stage 3)
Option 2: Consultation on UE’s Connection Charges and Ancillary Documents (Stage 4)
Option 3: Optional Contingency (25 consultancy days)
Tenderers should note that the CER does not guarantee that any of the options will be included in the total scope of this requirement.
A milestone payment schedule will be agreed between the CER and the successful tenderer. The draft anticipated milestone payment schedule for the mandatory and optional deliverables is given in Section 3.2 of the Invitation to Tender document and will be finalised in the Services Agreement signed with the successful tenderer.
Invoicing of drawdown contingencies & contingency days is not included in this payment schedule and will be determined if and when the CER decides to drawdown.
The Commission for Energy Regulation operates in accordance with the European Communities (Late Payment in Commercial Transactions) Regulations 2002.
A grouping, if successful, must contract as a single entity, having joint and severable liability
