Establishment of a multi-party framework agreement for integrated design team services with the back-up of a multi-disciplinary environmental consultancy team

The Contracting Authority is seeking to establish a multi-party framework
agreement for integrated design team services for the remediation of two landfill
sites, namely Pollboy Landfill, Ballinasloe and the East Galway Landfill, with the
backup of a multi-disciplinary environmental consultancy team for the licence
reporting and monitoring of the landfill sites. The framework agreement will be
established comprising the following disciplines: (a) Civil & Structural Engineering
Services, (b) Mechanical & Electrical Engineering Services, (c) Geotechnical
Engineering Services, (d) Hydrogeology Services, (e) Environmental Monitoring
Services, (f) Landscape Architect, (g) Quantity Surveyor and (h) Project
Supervisor for the Design Process.
Only those Applicants capable of delivering all of the services listed above
without exception (whether in-house or as a grouping/consortium) will be
considered. Therefore, applications relating to one or several of these disciplines
only are not acceptable and will be rejected outright.
The Integrated Design Team will be responsible for providing all construction-
related technical advice and design services for the initial contract and under the
framework agreement.
The maximum estimated value of services over the lifetime of the framework is
anticipated to be in the region of €500,000 - €1,500,000 (ex.VAT)

INITIAL CONTRACT:
The framework agreement will be established on foot of an initial contract for the design, implementation and supervision of the remediation of the East Galway Landfill (also known as Connaught Regional Residual Landfill). The initial contract will also include waste licence support (incl. reporting, surveying, monitoring and co-ordination of services related to licence compliance) and technical support (incl. technical advice on operational matters).
Nine cells have been constructed at the facility and Cells 1 to 7 have been filled with approx 820,000 tonnes of waste. Cells 1 to 7 have been capped with temporary geocomposite capping material and a section of Cell 1 has been permanently capped. Cells 8 & 9 have been substantially constructed but no waste has been placed in these cells.
The estimated duration of the initial contract will be 48 months. It must be noted that it will not be continuous as the capping works will be seasonal in nature.
Prior to the conclusion of the framework agreement, the Contracting Authority reserves the right to seek copies of any agreements between the members of the consortium if the successful tenderer(s) is a consortium or grouping of members.
The Contracting Authority reserves the right, at its absolute discretion, to require a lead firm to contract:
- on a basis of joint and several liability with each member of the candidate executing the contract;
- with a particular single member of the tenderer as the prime contractor, with the other members providing collateral warranties and/or guarantees, or;
- as an incorporated or unincorporated special purpose vehicle, with collateral warranties and/or guarantees from the members of the candidate.

1. The Contracting Authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers in response to this competition.
2. Establishment of the framework agreement will be subject to the approval and competent authorities.
3. If for any reason it is not possible to conclude the framework agreement with the successful tenderer(s) designate emerging from this competitive process, or if having concluded the framework agreement the Contracting Authority decides to terminate that agreement, the Contracting Authority reserves the right to admit the next highest scoring tenderer to the framework agreement on the basis of the same terms and as tendered by that party, at any time during the tender validity period.
4. At its absolute discretion, the Contracting Authority may elect to terminate this procurement process or the concluded framework at any time.
5. Tenderers should note that there is no restriction on any particular professional discipline participating in different consortia. However, in the event of such occurrences arising they must inform the relevant lead parties in writing in advance.
