Three Single party Framework Agreements for the Provision of Legal Services
Waterford
The contracting authority intends to establish Three single-party framework agreements for the provision of legal services to support the delivery of its activities. In this regard, it is envisioned that a range of support may be required across a full range of staff (i.e., partner, associate, solicitor, assistant solicitor legal executive and trainee). Waterford City and County Council wishes to have access to legal expertise and representation as set out below.
The frameworks will be established in Three Lots:
Lot 1 General Legal Services
This will cover the following:
a) Property related matters (including litigation)
b) General Local Government Legal Advisory Services, Enforcement and Prosecuting Liability, Defending Liability, Employment Law
Lot 2 – Specialist Legal Services
This will cover the following :
a) Contract Law (particular regard to Construction Contracts)
b) Procurement Related Legal Services
c) Specialist Planning Legal Services
Lot 3 – Debt Recovery
The above requirements represent the current anticipated range of legal services required by Waterford City and County Council during the operation of the proposed frameworks. However, due to on-going review and development of services provided by Waterford City and County Council, additional Legal service requirements may arise during the duration of the framework; thereby altering the possible value of the frameworks.
However, no guarantee can be given of the volume of work to be awarded during the life of the Frameworks
Candidates may apply to be included on the tender list for each Lot by completing the attached qualification questionnaire, for Lot 1 at Appendix A1 and Appendix B1, For Lot 2 at Appendix A2 and Appendix B2, for Lot 3 at Appendix A2 and Appendix B3
Ultimately candidates may be invited to Tender following evaluation of their questionnaire.
The Framework agreements will be established over a period of Four Years and may at the discretion of Waterford City and County Council, be used to source all or some of the Councils legal services requirements during the specified period.
Admission to the framework does not guarantee the award of any contract to any party.
Lot 1 General Legal Services
This will cover the following:
a) Property related matters (including litigation)
b) General Local Government Legal Advisory Services, Enforcement and Prosecuting Liability, Defending Liability, Employment Law
Lot 2 – Specialist Legal Services
This will cover the following:
a) Contract Law (particular regard to Construction Contracts)
b) Procurement Related Legal Services
c) Specialist Planning Legal Services
Debt recovery
WCCC require the services of an experienced debt recovery agent who is familiar with the specific requirements of the recovery process, including the following areas:
a) Initial engagement by correspondence and phone communication
b) Negotiation of settlement arrangements to an agreed timescale with the debtor and the local Authority
c) Be in a position to escalate if required and carry out seizure of assets directly for the Local Authority once all avenues are exhausted
To be agreed with the successful tenderer(s)
A grouping, if successful, will be required to contract as a single entity having joint and several liability

• As the subject matter of these framework agreements is a non-priority (Annex IIB) service, the establishment of the frameworks is not subject to the provisions of Directive 2004/18/EC with regard to the choice of procedure, timescales etc.Therefore, the awarding authority will employ a negotiated procedure under its own terms and conditions.
• Interested parties must register their interest on the e-tenders website (www.etenders.gov.ie) in order to be included on the mailing list for clarifications. All information relating to attachments, including clarifications and changes will be published on the Irish Government procurement opportunities portal (www.etenders.gov.ie) only. Registration is free of charge.
• This is the sole call for competition for these services.
• The contracting authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers.
• Contract award will be subject to the approval of the competent authorities.
• It will be a condition for admittance to the framework agreements that successful tenderers produce a valid tax clearance certificate from the Irish revenue commissioners and that they retain a fully valid certificate throughout the lifetime of the frameworks and of contracts awarded under the frameworks.
• Admittance to the frameworks will also be conditional upon formal written acceptance of Waterford City and County Council‘s Terms and Conditions.
• If for any reason it is not possible to admit one or more of the successful tenderers to the framework agreement following the conclusion of the competitive process, the contracting authority reserves the right to invite the next highest scoring tenderer to join the framework agreement as appropriate. This shall be without prejudice to the right of the contracting authority to cancel this competitive process and/or initiate a new contract award procedure at its sole discretion.
• Notwithstanding the existence of the frameworks, the contracting authority at its sole discretion reserves the right to engage in a separate procurement procedure outside of the frameworks for any contract arising for legal services.
• The contracting authority reserves the right to reduce the number of participants and the number of solutions to be discussed or tenders to be negotiated.
• The estimated total value of purchases for the entire duration of the Framework Agreements will be in the range of 1,000,000 to 1,400,000 for the three Lots
