Single Party Framework for Fibre-Optic Network and Infrastructure Management Services

The Framework Agreement will operate for a maximum period of 10 years. Given the nature of the service and the requirement to support a commercial environment with management of long-term relationships with clients of the Authority and matching service providers it is imperative to have consistency of service provision and thus a longer-term framework manages the risk for the Authority. In addition the service is classified as a service concession and therefore not subject to the requirements of Directive 2004/18/EC including duration rules on frameworks.
Initially a 3 year contract, additional contracts not known at this stage.
Dublin Docklands Development Authority invites applications to be considered for the competitive dialogue procedure for the awarding of a single party framework agreement for Fibre-Optic Network and Infrastructure Management Services at the Dublin Docklands Area.
The Authority wishes to appoint a company to provide and deliver a range of ducting related services to the Executive and the Board of the Authority and with its successor in Dublin City Council.
The Authority owns a substantial multi-operator network in the Docklands. This network is of extreme economic importance, providing Telecoms services to over half of the world’s largest financial services companies and a growing cluster of the most successful high tech/financial companies in the digital media and internet sectors.
The framework may operate for a maximum period of up to 10 years.
Not known at this stage and anticipated to be discussed during dialogues.

A grouping if successful must be prepared to contract as a single entity having joint and several liability.

Based on the quality of the responses to the questionnaire it is envisaged that a minimum of 5 will be invited to the dialogue stage.
1) Interested parties must register their interest on the eTenders web site (www.etenders.gov.ie) in order to be included on the mailing list for clarifications. All information relating to attachments, including clarifications and changes, will be published on the Irish Government Procurement Opportunities Portal (www.etenders.gov.ie) only. Registration is free of charge. The contracting authority will not accept responsibility for information relayed (or not relayed) via third parties
2) This is the sole call for competition for this service.
3) The contracting authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers.
4) Contract award will be subject to the approval of the competent authorities.
5) It will be a condition of award that candidates are tax compliant and are in a position to produce a valid tax clearance certificate from the Revenue Commissioners when requested.
6) If for any reason it is not possible to admit to the framework agreement one or more of the tenderers invited following the conclusion of this competitive process, or having awarded a contract under the framework agreement, the contracting authority reserves the right to invite the next highest scoring tenderer to join the framework agreement, deliver the contract as appropriate to the circumstances pertaining to the framework.
7) At its absolute discretion, the contracting authority may elect to terminate this procurement process, the framework agreement or any contract awarded under the framework agreement at any time.
8) Please note in relation to all documents, that where reference is made to a particular standard, make, source, process, trademark, type or patent, that this is not to be regarded as a de facto requirement. In all such cases it should be understood that such indications are to be treated strictly and solely for reference purposes only, to which the words “or equivalent“ will always be appended.
9) Without prejudice to the principle of equal treatment, the contracting authority is not obliged to engage in a clarification process in respect of questionnaires with missing or incomplete information. Therefore, candidates are advised to ensure that they return fully completed questionnaires in order to avoid the risk of elimination from the competition.
10) The service is defined as a service concession and therefore not subject to Directive 2004/18/EC.
