Establishment of a Multi-Operator Framework Agreement for the Haulage and Treatment of Leachate from Kerdiffstown Landfill
Co. Kildare
The Contracting Authority requires the removal and treatment of liquid material from Kerdiffstown Landfill to a licenced treatment facility, (the current designation is non-hazardous material. See analysis of leachate attached). Leachate will be required to be collected during normal operating hours for the facility, 0900-1300 and 1400-1700,(these may be subject to change), as well as on demand in the event of an emergency as set out below. The liquid consists of a mix of leachate generated from domestic and commercial waste in a lined landfill cell and leachate-contaminated storm-water run-off from a covered portion of waster in that cell.
The expected volume of non-hazardous liquid material to be removed could be in the order of 60,000 to 90,000 litres/day, depending to some degree on prevailing weather conditions. However, there is no guarantee of the volume of material to be removed and tenderers should have the flexibility to both increase and decrease their capacity within the range of 0 to 90,000 litres /day on a 365 day per year basis.
All collections will be on foot of a service request made by the Site Manager. Two types of service request will apply:
• Standard Service Request - a schedule of collections will be agreed with a successful tenderer by the Site Manager on a weekly basis in advance;
• Special Service Request - additional collections as they arise and are requested by the Site Manager.

Prior to the conclusion of the framework agreement, the Contracting Authority reserves the right to seek copies of any agreements between the members of the consortium if the successful tenderer is a consortium or grouping of members.
The Contracting Authority reserves the right, at its absolute discretion, to require a lead firm to contract:
- on the basis of joint and several liability with each member of the candidate executing the contract;
- with a particular single member of the tenderer as the prime contractor, with the other members providing
collateral warranties and/or guarantees, or;
- as an incorporated or unincorporated special purpose vehicle, with collateral warranties and/or guarantees
from the members of the candidate.

Leachate Contract - Kerdiffstown
1. The closing date for receipt of queries concerning this stage of the competition is 27.05.2015 at 17:00 hrs, (Irish time). All queries should be sent to the e-mail address jharrison@kildarecoco.ie
2. The Contracting Authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers in response to this competition.
3. Establishment of the framework agreement will be subject to the approval of the competent authorities.
4. If for any reason it is not possible to conclude the framework agreement with the successful tenderer designate emerging from this competitive process, or if having concluded the framework agreement the Contracting Authority decides to terminate that agreement, the Contracting Authority reserves the right to admit the next highest scoring tenderer to the framework agreement on the basis of the same terms and as tendered by that party, at any time during the tender validity period.
5. At its absolute discretion, the Contracting Authority may elect to terminate this procurement process or the concluded framework at any time.
6. The Contracting Authority undertakes to use its best endeavours to hold confidential any information provided in the proposal submitted, subject to the contracting authority‘s obligations under law, including the Freedom of Information (FOI) Act 2014. If you consider any of the information supplied by you is either commercially sensitive or confidential in nature, this should be highlighted and the reasons for its sensitivity specified. In such cases the relevant material will, in response to FOI requests, be examined in the light of the exemptions provided for in the FOI Act. It is the Contracting Authority‘s policy to consult with applicants before deciding on the release of information, which may be commercially sensitive.
