    Short description of the contract or purchase(s)

    Limerick City and County Council (LCCC) hereby seeks expressions of interest to undertake a development of the Opera Site (the “Site”). This Request to Participate (RTP) is the first stage in a competitive dialogue procedure. This stage of the process will consist of an assessment of the suitability of applicants to participate in the process. Those applicants who are deemed suitable will then be invited to participate in the dialogue stage of the process. It is anticipated that the dialogue stage will consist of two (2) phases. The successful applicant following completion of the competitive dialogue procedure will be granted a long leasehold interest (the “Interest”) in the Site being a right to develop, manage and realise the Site under an Agreement for Lease. The interest will be granted to the tenderer who has submitted the most economically advantageous tender based on the contract award criteria to be set out in the tender documents. It is LCCC’s intention to retain the freehold interest in the Site.

    (a) The Authority is subject to the Freedom of Information Acts 1997 and 2003. The Candidate shall state why it considers the information to be confidential or commercially sensitive. The Authority will consult with any Candidate / Tenderer about sensitive information before making a decision on any Freedom of Information request received.

    (b) Any contract award is subject to production of a current tax clearance certificate from the Revenue Commissioners in Ireland.

    (c) All costs incurred by candidates in preparing submissions must be borne by them. The contracting authority accepts no liability for these costs, irrespective of the outcome of the competition, or if the competition is postponed or cancelled.

    (d) The contracting authority may terminate this competition (or any part thereof), change the basis of and the procedures for the bidding process, at any time, or procure the contract by alternative means if it appears that it can thereby be more advantageously procured. The most economically advantageous or any tender will not necessarily be accepted.
