Consultancy Support for Water Division

The Commission for Energy Regulation (the CER) is the independent body
responsible for overseeing the liberalisation of Ireland‘s energy sector.
The Water Services Act, 2013 and the Water Services Act, 2014 expanded the
remit of the CER to include functions relating to the economic regulation of the
public water sector.
Section 22 of the Water Services (No. 2) Act 2013 states that the CER may,
having regard to certain matters including the costs likely to be incurred by Uisce
Éireann (UÉ), approve a water charges plan. The plan, which is developed by
and submitted to the CER by UÉ, specifies matters including charges to
customers and costs likely to be incurred by UÉ.
The CER has previously determined an interim revenue control for the period from
October 1st 2014 to December 31st 2016. The CER is of the view that the next
revenue control for UÉ should be for a period of two years.
The CER intends to engage consultancy support to provide technical, economic
and financial advice in regard to the next revenue control for Uisce Éireann, which
is expected to apply from 1st January 2017 to 31st December 2018. The
consultancy support will also provide other advice outside of the revenue control.
The support required is broken down into the following 3 Lots:
Lot 1 - Technical and Economic Consultancy Support for Uisce Éireann Price
Control (2017-2018)
Lot 2 - Financial Consultancy Support for Uisce Éireann Price Control (2017-2018)
Lot 3 – General Policy Advice
Tenderers may bid for Lot 1, Lot 2 or Lot 3 or any combination of Lots.

The scope of the revenue control project is to provide the CER with advice to assist it in the setting of allowed revenues for the UÉ business to cover the period 2017 to 2018. The scope also includes provision of advice regarding UÉ’s capital investment baseline plan, expenditure on capital investments during the interim revenue control period (October 1st 2014 to December 31st 2016) and delivery of associated outputs in the context of the CER’s decision on the allowed revenue for the interim period.

The scope of this Lot concerns the provision of policy advice to the CER Water division, specifically on consumer policy issues, as they arise.

It is proposed to put in place a contract for a period of one year with an option for renewal for up to a further two years (on an annual basis and subject to contract review and to the written agreement of the parties).
The maximum man-day requirement for the one year contract (and renewal options) is capped at 25 days per annum, drawn down as required. It is anticipated that this support will be provided off site.
After contract award a schedule of payments (highlighting delivery rated milestones) will be agreed with thesuccessful tenderers for Lots 1 & 2.
Indicative milestone schedules are provided in Section 3 of the Invitation to Tender (ITT).
A payment schedule for Lot 3 will be determined if and when the CER decides to drawdown the Lot 3 services.
The Commission for Energy Regulation operates in accordance with the European Communities (Late Payment in Commercial Transactions) Regulations 2002.
A grouping, if successful, must contract as a single entity, having joint and severable liability.
All tenderers are required to complete a Declaration of Bona Fides pursuant to Article 45 EU Directive 2001/1/EC (See Appendix B of Invitation for Tender).
