Special Condition 2 - Limitation of Liability
SC2 Contractor‘s Limitation on Liability. This clause does apply to this contract. Save in respect of fraud, personal injury or death (for which no limit applies), the limit of the Contractor‘s aggregate liability to the Client under this Agreement whatsoever and howsoever arising shall not under any circumstances exceed 150 per cent of the Charges paid or projected to be paid (Whichever is higher) under this Agreement regardless of the number of claims.
