Appointment of various multi-disciplinary consulting engineering and design teams pertaining to the remediation and development of Haulbowline Island, Cork Harbour, Ireland.

The Contracting Authority (acting as agent for the Minister for Agriculture, Food and the Marine in relation to the remediation of Haulbowline Island) is now engaging in a competitive tendering process for the appointment of various multi-disciplinary consulting engineering and design teams pertaining to the remediation and development of Haulbowline Island, Cork Harbour, Ireland.
The requirements are divided into 2 no. lots:
• Lot 1: multi-operator framework agreement for Site Preparation Design & Advisory Teams; and
• Lot 2: multi-operator framework agreement for Client Teams for the main remediation and development works.
Interested parties may apply for one or both Lots. The successful economic operators under Lot 1 may be required to prepare briefs and evaluate proposals submitted by the successful operators under Lot 2. Such potential conflicts of interest will be addressed during the award of call-off contracts under Lot 1.

The Contracting Authority reserves the right to exercise the option referred to in Article 31(4)(b) of Dir 2004/18/EC to award to the Consultant under each Lot new services consisting in the repetition of similar services to those entrusted to the Consultant, provided such services are in conformity with a basic project for which a Contract was awarded. This option may only be used by the Contracting Authority during the three years following the conclusion of a Contract under each framework.
The Contracting Authority (acting as agent for the Minister for Agriculture, Food and the Marine in relation to the remediation of Haulbowline Island) is engaging in a competitive tendering process for the establishment of a multi-operator framework agreement for Site Preparation Design & Advisory Teams pertaining to the remediation and development of Haulbowline Island, Cork Harbour, Ireland.
The framework agreement will be established with three (3) operators, subject to the receipt of a sufficient number of valid tenders.
Each of the operators will include all of the following disciplines:
• Project Management Services
• Civil Engineering (and associated specialist skills)
• Environmental Engineering Services (and associated specialist skills)
• Ecology
• Project Supervisor for the Design Process
Only those Candidates capable of delivering all of the above-mentioned disciplines and associated specialist skills (whether in-house or as a grouping/consortium) will be considered. Therefore, applications relating to one or several of these disciplines and/or skills only are not acceptable and will be rejected.
Candidates will be required to nominate a Lead Party who will have a single point of contractual responsibility, with the remaining disciplines providing collateral warranties for the benefit of the Contracting Authority.
The framework agreement will be established on foot of a competition for an initial contract for multi-disciplinary consulting engineering and design services for a slag processing and recovery trial works.

Prior to the conclusion of each framework agreement, the Contracting Authority reserves the right to seek copies of any agreements between the members of the consortium if the successful tenderer is a consortium or grouping of members.
The contracting authority reserves the right, at its absolute discretion, to require a lead firm to contract;
- on the basis of joint and several liability with each member of the candidate executing the contract,
- with a particular single member of the tenderer as prime contractor, with the other members providing collateral warranties and/or guarantees; or
- as an incorporated or unincorporated special purpose vehicle, with collateral warranties and/or guarantees from the members of the candidate.

It is envisaged that the top 6 scoring Candidates (subject to the quality and number of SAQs received) under each Lot, and which also meet the minimum criteria and rules for selection, will be invited to tender for that Lot.
1. The closing date for receipt of queries concerning this stage of the competition is 2 January 2015 at 16:00 hrs (Irish time). All queries must be sent by email to haulbowlineremediation@corkcoco.ie.
2. The Contracting Authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers in response to this competition.
3. Establishment of each framework agreement will be subject to the approval of the competent authorities.
4. If for any reason it is not possible to conclude a framework agreement with one or more of the tenderers invited, or if having concluded that framework agreement the Contracting Authority decides to terminate the appointment of one or more of the framework members, the Contracting Authority reserves the right to admit the next highest scoring tenderer(s) to that framework agreement on the basis of the same terms and as tendered by that party(ies), at any time during the tender validity period. This shall be without prejudice to the right of the contracting authority to cancel this competitive process and/or initiate a new contract award procedure at its sole discretion.
5. If for any reason it is not possible to conclude the initial contract with the successful framework member, or if having concluded that initial contract the Contracting Authority decides to terminate it, the Contracting Authority reserves the right to award the initial contract to the next highest scoring framework member on the basis of the same terms and as tendered by that party at any time during the tender validity period. This shall be without prejudice to the right of the contracting authority to cancel that competitive process and/or initiate a new contract award procedure at its sole discretion.
7. At its absolute discretion, the contracting authority may elect to terminate this procurement process or the concluded framework agreement at any time.
