    Short description of the contract or purchase(s)

    The Minister for Justice and Equality (“the Contracting Authority”) invites responses (“Responses”) to this contract notice including appendices 1 - 5 (which together form the “Contract Notice”) from economic operators (“Candidates”) for the provision of ICT managed services as described in more detail in Appendix 1 of this Contract Notice (“Services”).

    Undertakings who wish to participate in this public procurement competition must:

    1. comply with all requirements as set out in this Contract Notice and

    2. complete and return with their Response the documentation at Appendices 3-5 to this Contract Notice.

    Failure to comply with the requirements as set out in this Contract Notice and/or the non-provision of any requested information or document in this Contract Notice may render the Response invalid (“Invalid Response”). Candidates may include additional information and documentation that they consider necessary to provide a sufficient response to this Contract Notice. The Contracting Authority may reject Invalid Responses from this public procurement competition. The Contracting Authority shall consider all valid Responses against the qualification criteria at Part III of this Contract Notice.

    Information and formalities necessary for evaluating if the requirements are met:

    Candidates must include a statement confirming whether any of the excluding circumstances listed in Article 45 of the EU Council Directive 2004/18/EC as implemented into Irish law by Regulation 53 of the European Communities (Award of Public Authorities’ Contracts) Regulations 2006 (Statutory Instrument 329 of 2006), apply to the Candidate. Candidates from Ireland and the United Kingdom must include with the Tender the declaration at Appendix 5 to this Contract Notice (“Declaration”). For Candidates outside Ireland and the United Kingdom the statement must be evidenced as appropriate.

    Economic and financial ability

    Information and formalities necessary for evaluating if the requirements are met:

    1) 1) Proof of economic standing and financial standing by means of presentation of balance sheets.

    Minimum level(s) of standards possibly required:

    Candidates must demonstrate that they have had an overall turnover of not less than €20million for each of the three immediately preceding years.

    Candidates will either pass OR fail this qualification criterion.

    Candidates must provide the following specified documentation with their Response. However, where the Candidate is unable, for a valid reason, to provide that documentation, the Candidate must inform the Contracting Authority of that valid reason as to why it cannot be supplied and can provide such other suitable alternative documentation to prove, to the satisfaction of the Contracting Authority, their economic and financial capacity:

    Copies of audited financial statements which must include an unqualified audit report of the financial statements.

    Candidates should note that economic operators relying on the capacity of other entities must submit an undertaking duly evidenced when requested by the Contracting Authority from those entities that they will place the necessary resources at the disposal of the Candidate.

    Minimum level(s) of standards possibly required:

    1. Candidates must demonstrate they have the level of experience to provide high quality services of a similar type, scale and complexity sought in this public procurement competition. Candidates will either pass OR fail these qualification criteria.

    Candidates must include the following with their Responses to demonstrate this criterion:

    (i) List of principal contracts undertaken in the last 3 years providing services of a similar type, scale and complexity to those sought in this public procurement competition, with an indication of the scale of the contracts, dates and recipients, of the service provided;

    (ii) three satisfactory references (including contact name and details). The Contracting Authority may contact any or all referees without prior notice being given to the candidate; and

    (iii) The CVs of the key personnel who will be assigned to provide the Services for the duration of the contract.

    2. Candidates must have obtained quality management accreditation to the EN29000 – ISO9000 standard or equivalent. Candidates must include evidence of their accreditation with their Response.

    Candidates should note that economic operators relying on the capacity of other entities must submit an undertaking duly evidenced with their Response from those entities that they will place the necessary resources at the disposal of Candidates.
