Single-party framework agreement for programme management services for the HBAN Programme
Island of Ireland
The Governments of both the Republic of Ireland and Northern Ireland recognise the importance of encouraging new innovative high potential start-ups for the growth and future prosperity of the economy. To facilitate such activity, it is acknowledged that a stable and appropriate supply of finance is required. The objective of the HBAN Programme is to deliver a regionally focused Business Angel ecosystem that reflects international best practice, with more active and better trained Business Angels, well-formed and functioning Syndicates who will ultimately invest more capital into a larger number of early stage companies.
Enterprise Ireland and InterTradeIreland (together, ‘the Contracting Authority’) are seeking tenders for the establishment of a single-operator framework agreement for the provision of programme management services for the HBAN Programme. The framework operator will be required to manage and operate the HBAN Programme and deliver a range of services that will develop the overall Business Angel Ecosystem and facilitate investment into early stage companies.
The framework agreement will be established on foot of an initial contract for programme management services as further described in section 3 of the Invitation to Tender document.

The Contracting Authority reserves the right to exercise the option referred to in Article 31(4)(b) of Directive 2004/18/EC to award to the framework operator new services consisting in the repetition of similar services to those entrusted to the framework operator, provided such services are in conformity with the advertised project.
Prior to the conclusion of the framework agreement, the Contracting Authority reserves the right to seek copies of any agreement between members of the consortium if the successful tenderer is a consortium or grouping of members.
The contracting authority reserves the right, at its absolute discretion, to require a lead firm to contract;
- on the basis of joint and several liability with each member of the candidate executing the contract,
- with a particular single member of the tenderer as the prime contractor, with the other members providing collateral warranties and/or guarantees; or
- as an incorporated or unincorporated special purpose vehicle, with collateral warranties and/or guarantees from the members of the candidate.

- This is the sole call for competition for these services.
- The Contracting Authority will not be responsible for any costs, charges or expenses incurred by tenderers in response to this competition.
- Establishment of the framework will be subject to the approval of the competent authorities.
- If for any reason it is not possible to conclude the framework agreement with the successful tenderer designate emerging from this competitive process, or if having concluded the framework agreement the Contracting Authority decides to terminate that agreement, the Contracting Authority reserves the right to admit the next highest scoring tenderer to the framework agreement of the basis of the same terms and as tendered by that party, at any time during the tender validity period.
- At its absolute discretion, the contracting authority may elect to terminate this procurement process or the concluded framework agreement at any time.
