    Participants in this process should be aware that the services sought herein are listed in Annex IIB to Directive 2004/18/EC (the “Directive”) and, accordingly, are not subject to the provisions of the Directive, with the exception of certain requirements in relation to specifications (Article 23) and the publication of a contract award notice (Article 35(4)). As the procurement of legal services involves an Annex IIB service, the Contracting Authority has flexibility in regard to the procurement procedure it utilises. The procedure complies with fundamental EC law principles (including equal treatment, transparency and proportionality) and obligations under the Procurement Regulations in regard to technical specifications and award notices.

    In order to access the Competition Briefing Documents, interested parties are required to download and complete the Request for Competition Documents form associated with this notice. Access to the competition documents is confined to practicing Solicitors and/or Barristers who have a bona fide interest in participating in this competition.

    While the form of Contract Notice indicates a Negotiated procedure, candidates should note that the Contracting Authority is running this competition by way of a 2 stage procedure similar, but not identical to a Restricted procedure under the Directive. The form of Contract Notice facilitates this approach.
