1) Tenderers must sign the "DoES Suitability Declaration for Small Works" available at www.education.ie under School Planning/Building > Technical Guidance, and if requested to do so must provide the necessary evidence of compliance stated in that document within 7 days, including evidence of annual turnover greater than 1.5 times the sum tendered and H&S competence.
2) Contract is intended to be awarded to a single main contractor.
3) This is an open tender contract notice. There is no limit on the number of tenderers.
4) Tenderers are required to read Department of Education & Skills DoES Contractor Suitability Declaration carefully to make sure that they meet the minimum standards stated therein. Tenderers who do not meet these requirements should not submit a tender as they will be excluded at award stage.
5) All tenders are liable for their own costs of tendering.
6) The contract will be the Short Public Works Contract available at www.construction procurement.ie.
7) The signed declaration will be validated prior to issuing out the tender packs. Tenderers will be required (on written request) to provide the evidence in support of the declaration within a period of 7 calender days. If a firm cannot or does not provide all of the required evidence, within the above time period their tender will be deemed to be invalid and will be excluded from further consideration.
8) There are no Contractor or Employer named specialists. All sub-contractors are domestic.
9) The successful applicant will be appointed Works Contractor and Project Supervisor for the Construction Stage (PSCS) on the project in accordance with the Safety, Health and Welfare at Work (Construction) Regulations.
10) The project categorisation for assessment of H&S competence as Works Contractor and PSCS is Type 1.
11) It is a condition precedent to the award of the Contract tat the successful Tendrer will provide:
a) A current tax clearance certificate or in the case of a non-resident Contractor a statement of suitability on tax grounds from the Revenue Commissioners of Ireland.
b) Evidence showing that they are in compliance with the registered employment agreement (Construction Industry Pensions Assurance and Sick Pay).
c) Proof of Insurances: Minimum level of €6.5million Public Liability Insurances and €13million Employers Liability.
d) Evidence of an annual turnover of 1.5 times the contract tender price. (The onus rests with the Tenderer to check the completeness of the documents downloaded, issued in hard format such as CD, DVD, USB memory stick SD card of the like. Where such downloads or hard format documents are incomplete or illegible, the Tenderer must notify the party issuing the documentation immediately.)
12) Tender Returns must be in printed format.
13) The Department of Education and Skills is subject to the requirements of the Freedom of Information Act 1997. If a candidate considers that any of the information supplied in response to this notice is either commercially sensitive or confidential, this should be highlighted and reasons for its sensitivity given. The relevant material will, in response to a request under the Act, be examined in the light of exemptions provided for in the Act.
14) All required Tenderer documentation must be valid prior to and throughout the entirety of the Contract.
Please be aware that noting/ expressing an interest on the E-Tender advert alone IS NO T SUFFICIENT to be placed on the approved tender list for these works. There are minimum requirements set out above in this E-tender advert that must be met. Only receipt by the consultant engineer of a signed Suitability Declaration document accompanied by five (5) contactable client references on or before the deadline will constitute a successful Expression of Interest.
