The Contracting Authority invites you (as a participant in the above Framework) to tender for services in the above consultancy discipline as detailed below.
Form of Contract
The form of Contract will be the Standard Conditions of Engagement for Consultancy Services (Technical COE1) including the Template Schedule A and B (attached).
Tender Returns
The latest time and date for return of Tenders is: 17.00hrs, Friday 6th March 2020.

Tender submissions must be signed and received by eTenders portal only, with the onus resting with the Tendering party to ensure receipt of the submission before the latest time and date for receipt of tenders
Tenders will be assessed on the basis of the Most Economically Advantageous Tender (MEAT). The marks for each of the criteria will be as stated in this document.
Tenders not submitted via the eTenders portal will be deemed to be invalid tenders. Unsigned tenders/tender proposal forms will likewise be deemed to be invalid tenders. The signatures for both documents must be that of a Principal or Director of the firm.
Tenders must be in the format prescribed in the Form of Tender/Tender Proposal Form.

Queries
Queries must be submitted by email on the eTenders portal only.

Description of the Project
Project Brief
The brief for the project is to design and procure additional accommodation for the school as set out in Schedule of Accommodation in Appendix A, which includes provision of a 2 Classroom SEN base (Total area incl walls and circulation 524m2). External areas to include a secure hard and soft play area (200m2), a sensory garden (100m2) (subject to prior Departmental agreement in writing) and 6 x parking spaces.

Scope of Work
The provision of Project Supervisor (Design) Process services for the Department and bodies under its aegis or acting on its behalf, including the following:
· General duties of Project Supervisor (Design Process) under the Health Safety and Welfare at Work (Construction) Regulations 2013 and Safety, Health & Welfare Act 2005.
· Meeting with and advising the client on the client’s duties and responsibilities under the Health Safety and Welfare at Work (Construction) Regulations 2013 and Safety, Health & Welfare Act 2005 including providing a written check-list of duties, responsibilities and key actions required.
· Assisting the client in the assessment of competency and sufficiency of resources of Designers in accordance with Health Safety and Welfare at Work (Construction) Regulations 2013. It is envisaged that this will be limited to assessing the competency of those consultants provisionally selected for appointment and will occur before the client confirms those appointments. In some instances where a putative appointee is deemed not to be competent or to have inadequate resources, more than one assessment of each discipline may be required.
· Assisting the client in a Health & Safety assessment of all briefing documents including all relevant design guidelines, standard documents, drawings, layouts and other documentation which may impose design restrictions which affect the Health & Safety of the Project, and in conjunction with the other Design Team members seeking to eliminate, reduce or manage any risks arising there from as appropriate. In this regard, the briefing documents (which will be provided by the Contracting Authority in each case) will include a preliminary Health & Safety Plan/Health & Safety audit (not site-specific) of the standard design guidelines, documents and layouts.
· Attending Design Team meetings (as required to fulfil the duties of PSDP) recording health & safety issues, and ensuring that particular hazards and risk are addressed in an appropriate manner.
· Preparation of an overall Design Safety Report to be issued to the client (prior to tenders being sought) summarising the risk assessments of all the designers (and the actions arising there from) and commenting on the extent to which safety has been considered at the design stage.
· Preparation of a Preliminary Health & Safety Plan for the construction of the project.
· Assessing the competency and sufficiency of resources of Contractors to act both as Project Supervisor (Construction Stage) and as Contractors. In this case the full submissions of all candidates provisionally pre-qualified will be referred to the PSDP for assessment. The scope of work includes direct communication with the candidate contractor where additional information or clarification is required. In some instances where a contractor is deemed not to be competent or to have inadequate resources, additional assessments may be required.
· Assessing the competence of the Specialist Contractors to act as domestic sub-contractors (where relevant) to the pre-qualified Main Contractors. The submissions of these specialist contractors will normally form part of the Main Contractor’s submission already referred to the PSDP for assessment. The scope of work includes direct communication with the candidate specialist contractor where additional information or clarification is required. Where a specialist contractor is deemed not to be competent or to have inadequate resources, additional assessments will only be required where that specialist is the only competent pre-qualified specialist for that contractor in that area of specialisation.
· Assessing the competence of the Reserved Specialist Contractors (where relevant – applies to projects with a notional capital value of €9m ex VAT or higher). The submissions of these Reserved Specialist Contractors will be assessed in terms of competency and sufficiency of resources to act as Reserved Specialists to the Main Contractor. The scope of work includes direct communication with the candidate Specialist Contractor where additional information or clarification is required. In some instances where a Specialist Contractor is deemed not to be competent or to have inadequate resources, additional assessments may be required.
· Attending site meetings as required. The extent to which the PSDP will be required to attend site meetings will be at the discretion of the PSDP, but should be sufficiently frequent to ensure that all design safety issues are discussed and appropriate action taken
· Preparation of a Safety File and issuing that safety file to the client, including written advice to the client on their duties and responsibilities regarding the use and maintenance of that safety file. The preparation of the safety file will not include the actual preparation of drawings, specifications and construction documentation. Such drawings and documents (e.g. as built drawings etc.) will be prepared by the relevant consultant or contractor. The PSDP will be responsible for the format, the body of the document and the overall content of the safety file and will have the authority to request reasonable information from the relevant consultant and/or contractor.
The Total Performance Period for the performance of the Services is for the project duration including the Defects Period (12 months) and Client float. Performance periods for the performance of each Stage is stated in the Instructions to Tenderers.
The Scope of Services may be increased or decreased at the discretion of the Contracting Authority and the fee for such increases/ decreases will be determined at the Client’s choice in proportion to the increase/decrease in those Services or by the Scheduled Time Charges for changes as specified in Clause 11 of the Conditions of Engagement.
Basis of Assessment for Award Criteria:
Compliance Check
Tenders may be checked for compliance with this Invitation to Tender and the Form of Tender/Tender Proposal Form. Tenders which do not comply with these requirements may be excluded from further consideration.
Criterion A - Comparative Cost of Tender [30 marks]
The lowest qualifying tenderer receives 30 marks. Each other qualifying tenderer loses 0.5% of the marks for each 1% difference between that qualifying tender and the lowest price. In other words if Tenderer A’s price is 40% more than the lowest qualifying price, then Tenderer A is entitled to 30 marks less 20%, i.e. 24 marks.
Criterion B - Resources Devoted to Project [45 Marks]
Criterion B is divided into 2 sub-criteria: B1 – Rates tendered [20 marks] and B2 – Resources (Hours) devoted to the project [25 marks]. A minimum of 40% for each of the sub-criteria is required. If a tenderer received less than 40% for either sub-criterion B1 or B2, the tender will be excluded.
B1 – Rates tendered.
The Rates Tendered (averaged across the grades) are compared against the average Rates Tendered (averaged across the grades). If the Rates Tendered are higher than or equal to the average rate less 10% the tenderer will receive full marks. For each % below that level the tenderer will lose marks pro rata such that a Tenderer 40% (or more) less than the average will receive 0 marks. The average rates across the grades are calculated as stated in B2 below
B2 – Hours devoted to the project
The total hours for Stage Services are used to determine the marks for Resources. This sum is calculated by dividing the tender sum by the average hourly tendered rate to get the hours for Stage Services. For the PSDP consultant the average rate is calculated as 0.1 x the Director rate + 0.5 x the Project Senior rate + 0.4 x the Support Staff rate.
The total hours for Stage Services (as above) will be compared against the average Total Hours for Stage Services of all valid tenderers. If the Total Hours for Stage Services is higher than or equal to the Average Stage Services Hours less 10% the tenderer will receive full marks. For each % below that level the tenderer will lose marks pro rata such that a Tenderer 40% (or more) less than the average will receive 0 marks.
Criterion C (25 Marks] (PSDP Only)
Criterion C, Project Assessment, 25 Marks, is not applicable to the PSDP assessment. By default all candidates are awarded the maximum mark for Criterion C on the excel spreadsheet in order to give a possible maximum mark of 100.
